U.S. Congress backs bill authorizing $633 billion for defense in 2013

WASHINGTON (Reuters) - The U.S. Congress approved the final version of the annual defense policy bill on Friday, authorizing $633 billion in defense spending for 2013, tightening sanctions on Iran over its nuclear program and beefing up security at U.S. embassies.

The Democratic-controlled Senate voted 81-14 in favor the National Defense Authorization Act. The vote followed approval of the legislation by the Republican-controlled House of Representatives on Thursday and sent the measure to President Barack Obama for his signature.

The legislation authorizes a Pentagon base budget of $527.5 billion, plus $88.5 billion for overseas operations, primarily the war in Afghanistan. The base budget includes $17.4 billion for defense-related nuclear programs at the Department of Energy.

The NDAA sets defense policy for the year. While it authorizes spending levels for different military programs, it does not appropriate the money. That is done under separate legislation in the House and Senate.

In addition to authorizing the size of the military budget, the bill approved a 1.7 percent pay increase for military personnel and blocked a Pentagon effort to offset rising healthcare costs for retirees by raising some health insurance fees.

The bill calls for tightening sanctions on Iran because of its nuclear program, targeting shipbuilding, shipping and energy sectors for additional restrictions in an effort to boost pressure on Tehran to abandon its uranium enrichment.

The measure directs Defense Secretary Leon Panetta to develop and implement a plan to increase the number of Marines assigned to American embassies and consulates worldwide by up to 1,000.

The move aims to bolster diplomatic security following the deaths of U.S. Ambassador Christopher Stevens and three other Americans in an attack on the consulate in Benghazi, Libya.

The bill eases restrictions on the export of satellites to help U.S. manufacturers, who have seen their global share of the market shrink to less than 25 percent from 65 percent 15 years ago, officials said.

It also allows the Pentagon to continue its efforts to develop biofuels, rejecting a House attempt to prevent the purchase of fuels that are more expensive than petroleum.

The measure prohibits a final U.S. payment of $400.9 million for development of the Medium Extended Air and Missile Defense System, known as MEADS, which is being developed by Lockheed Martin with partners in Italy and Germany.

Lawmakers say Washington has no plans to produce the system, which has been in development for a decade at a cost of $4 billion. But officials say termination fees may nearly equal the cost of completing the system and the White House has warned that failure to approve the funding could hurt ties with allies.

The final measure also extends restrictions blocking any administration effort to imprison Guantanamo detainees in the United States.

Factbox: Patchwork of U.S. regulations governs firearms

(Reuters) - The Second Amendment to the U.S. Constitution says Americans have the right to bear arms, but the sale, possession, transportation and use of weapons are covered by a host of local, state and federal regulations.

Gun laws have come under scrutiny after 26 people were killed in a shooting rampage at a Connecticut school on Friday. The suspected shooter, Adam Lanza, is believed to have stolen the guns from his mother.

Some U.S. politicians, including President Barack Obama, have called for tightening U.S. gun laws, including a ban on so-called assault weapons.

Guns bought from licensed dealers are subject to federal and state laws and frequently require background checks and waiting periods. Buyers purchasing firearms from private sellers can usually avoid such checks and delays.

Here is an overview of the patchwork of federal and state laws applying to firearms:

** U.S. federal law only permits a "qualified law enforcement officer" with proper agency-issued identification to carry a concealed firearm. But every state in the nation, except Illinois, now allows residents to carry concealed weapons. An appeals court earlier this month ruled the Illinois law banning most people from carrying handguns in public is unconstitutional.

** The 49 states that permit the concealed carry of firearms are broken up into two groups: "shall issue" states and "may issue" states.

In so-called "shall issue" states, officials are required to issue a permit to anyone who meets minimum requirements.

Once a permit is issued, the permit holder may carry a loaded, concealed firearm in a public place -- although a number of states prohibit concealed weapons in specified locations.

There are 35 "shall issue" states, including Florida, Indiana, Michigan, New Hampshire, Ohio, Pennsylvania, Texas and Washington.

In the so-called "may issue" states, including Alabama, Connecticut, Hawaii, Massachusetts and New York, officials have discretion to grant or deny the permit, based on various statutory factors. Most "may issue" states require applicants to show a bona fide need to carry a concealed firearm.

In addition to the "shall issue" and "may issue" states, there are four states -- Arizona, Alaska, Vermont and Wyoming -- where no permit is required to carry a concealed weapon.

Of the 49 states that allow concealed weapons, fewer than half require applicants to demonstrate basic knowledge of firearm use and safety. They are California, Connecticut, Delaware, Hawaii, Iowa, Kansas, Kentucky, Massachusetts, Michigan, Missouri, Nebraska, New Jersey, North Carolina, Oregon, Rhode Island, South Carolina, Texas and Utah.

** Most states limit where firearms are allowed and ban them outright from school property, prisons and jails, courthouses and other government buildings, and places where liquor is served.

A smaller number of states prohibit concealed weapons in places of worship, polling places, sports arenas, hospitals and mental health facilities and casinos.

A handful of states, including Oregon, place almost no limit on where concealed weapons may be carried.

** There is no federal ban on assault weapons -- semi-automatic firearms designed with military features to allow rapid and accurate spray firing. A ban adopted in 1994 expired in 2004 when Republican George W. Bush was president, and was not renewed.

** Seven states have imposed bans on assault weapons and the high-capacity magazines that increase their killing potential --- California, Connecticut, New York, New Jersey, Hawaii, Maryland and Massachusetts, plus the District of Columbia. TWST: In general, how would you describe your investment strategy as it pertains to the OCM Gold Fund?

Mr. Orrell: Our first approach always comes from the macro standpoint of where we believe gold is going - what's gold doing? And then, we go from there to the individual issues. So looking at mostly in the mining stocks, we are predominantly in the gold miners, and we have what we call a tiered approach of having positions in major producers and immediate junior producers, and the exploration and development companies. And then, that percentage allocation in each group changes depending on our view of where we believe the value is. Further, we do believe that capital flows do run down to each segment, depending on where you are in various cycles in the gold market at that moment. So we like to have companies that are exhibiting strong fundamentals, from cash flow generation to reserve replacement to reserves per share, and we also are looking for companies that can create value through the drill bit.

TWST: Would you elaborate a little bit about the characteristics you're looking for in a gold mining company? And conversely, what would make a gold mining company an unattractive investment in your mind?

Mr. Orrell: What we're looking for are companies that are showing discipline. On the larger side, we're looking for companies that are showing a discipline in terms of their capital deployment, and that they're holding equity dear. That has certainly been an issue. Mining companies that have become serial issuers of equity; that's not what we're looking for. We know that it is a capital-intensive business, but there has to be a measured approach. So the companies that we focus on in our portfolio are companies that have exhibited an ability to manage their business in terms of doing what they say they are going to do - replacing reserves while also looking to grow their production portfolio with higher-quality assets. Basically, that's what we're looking for.

Conversely, companies that we're shying away from are companies that have exhibited a poor track record of execution - from reserve replacement to capital deployment. We avoid companies that are not investor friendly from the standpoint of realizing that shareholders need to see a return on equity through dividends. Companies that do put the shareholder high on that priority list, and that there is going to be a call on a portion of the cash flow from each operation because the mining business is a depleting resource business and the shareholders need to participate in each operation - we want companies where the management sees that. Otherwise, it's a fool's game for the investor where the only winners are engineers, geologists, suppliers and the tax man.

Q.?Please introduce yourself and let everyone know a little bit about where you?re from and say a few words about how you got started in the online world.?

In 2006 I started a web design company because I was bored with the corporate world (after 4 whole years!). I worked on that business for 6 years with a lot of ups and downs and in 2012 decided to sell it and move on to Inform.ly. While in my last business I built up my blog to a point where it was ranking number 1 in Australia for ?website design? and a lot of other big keywords and got a bit addicted to producing content.

Q. I?m a fan of your podcast Web Domination and I know from listening to it that you are a designer and you sold you design site and business. It?s a very intriguing story can you share it with us? What made you decide to sell the site?

I guess I battled for a lot of years really trying to work out how I could make it into something more than just a smallish agency and I never quite figured it out. I never really felt that it was the best business for me to be running and always dreamt of running more of a product business where I could focus 100% on product and content and not on ?consulting? (which I?m no good at). There?s only so many WordPress sites you can build for small businesses before you want to do something a bit ?bigger?.

Q. Now, let?s chat about the podcast. It seems like podcasting is a really hot trend right now but I find that many of my readers are intimidated by the idea of getting behind the microphone or learning a new skill. Can you give us a some advice and talk about what it was like for you to start a podcast. Did you hire a coach or did you have some past experience with podcasting?

Yes, I thought about doing a podcast for quite a while and then one day I decided to do it and the following day my first episode was live.?I?ve?written this Beginners guide to podcasting which will hopefully help others through the initial hurdles. Like most things it?s very easy to start once you decide to it?s just not that easy to keep going. Q. One of the other hot trends these days is outsourcing. Specifically, let?s focus on your design website ? did you do any outsourcing and when did you know it was time to outsource? Also, how did you find good people to work with?

I don?t really think of it in terms of outsourcing. In my design business I had a team made up of people in Australia, the Philippines, Europe and the US. Some were employed full time (Australia and Philippines), some were service providers like web hosts etc and some were contractors (design) but they were all part of the team and the word ?outsourcing? doesn?t really capture that for me.

I?ve tried everything to find good people to work with. The number 1 thing I do is I never employ anyone before giving them a trial first (if I can help it). So with all of the employees I ended up with, they all did paid trials before I employed them. With most of the service providers I tested them out in some way before engaging them ? often just seeing how responsive they were to emails etc before I signed up.

Q. It?s really time we start talking about Inform.ly now. Please tell everyone what Inform.ly is and why you decided to create it?

Well I built Inform.ly for web savvy small business people who want a quick way of viewing stats for their business. They can connect to their favourite services like Google Analytics, MailChimp, AWeber, Xero etc. and Inform.ly will show them a dashboard of simple stats all on the one page.

It has a bit of a long history which I cover in this Inform.ly launch case study. But the short version is I knew my clients in my web design business in general couldn?t understand the complex reports that were generated by Analytics and other services so I built a tool that I could use to email them simplified versions. This meant I was at the forefront of their minds and I could them value each month without doing much myself. After a while I figured it would be more than just my clients that could use reports like this so I decided to focus on building something available to the public.

We are currently working on the agency version of Informly which will let users send these reports to their clients but for now it?s just available to individual business owners.

Q.?I?m a blogger and I do email marketing and affiliate marketing how can Inform.ly help me and others like me compared to a small business owner or someone selling their own products and hard goods? Would we use it differently? What?s your vision for how people will use Inform.ly?

Yes, I think you will probably get more out of it because more of your important information is in the cloud. For example you can view your newsletter stats, your web stats, information on the impact of your blog posts etc. We are also working on more services that will show your affiliate earnings etc. The more services we integrate with the more useful it will become for people.

Q. How many people do you have working on the Inform.ly team and what was the hiring process like ? did you ever have to let anyone go because they?weren?t?up to snuff? Any good behind the scenes gossip you can share? We can change the names to protect the innocent of course :) I imagine that launching a?start-up?has it?s fair share of ups and downs.

It?s me, 2 full time developers and contractors or service providers for other stuff (design etc). One of my developers came across with me from my last business and I have employed the other one since starting Inform.ly in August.?I?ve?had to go through maybe 10-20 trial runs with others to find them, some of which?I?ve?employed and?they?ve?left or?I?ve?let go. My 2 developers are great and it?s amazing what they have been able to build in a short amount of time. Not sure about other goss?

I?m only 4 months in so I?m sure there are more ups and downs to come!

Q. You also have a blog for Inform.ly ? I?m sure many of my readers will want to check that out and some of the writers here might be interested as well. What are the topics you plan to cover there and are you opening the blog up to guest authors?

I want the Inform.ly blog to become a world class destination for any small business owner looking to dominate online.

The blog currently includes a number of in depth ?guides? on things like Google Analytics, Podcasting etc, and we are working on more. These are typically very detailed, specific actionable posts often 2,000-3,000+ words.?I?ve?also got 2 podcasts, Infographics, video training and a few less than serious business videos. The blog is going to be the only way I market the standard version (non agency) of Inform.ly other than through natural product coverage so I?m 100% committed to making it great.

Free cancer screenings offer peace of mind to men and their loved ones

DECATUR ? The Macon County Health Department is urging area men to give their families a special gift this holiday season.

By taking charge of their health and getting screened for prostate cancer, men can give their loved ones some peace of mind and make sure they are around for years to come, said health educator Tayisha Nelson.

As part of a prostate and testicular cancer grant, the department is offering free PSA blood screenings to help test area men. The department recently offered one free screening event and will host several more during the month.

?Our current prostate cancer grant is actually coming to a close at the end of the year, and we found that we had a little bit of funding left, so, we decided that we might as well go all out and make a couple of different accessible events,? said Brandi Binkley, the department?s director of health promotion and public relations.

By the end of the year, more than 300 men will have been screened for the cancer and educated at various community outreach events, she said.

The holidays are a busy time, but around all the activities with family and friends, it?s important to make health a priority, said Nelson. ?We want to have a reminder that we want men to continue to have holidays with their families.?

The screenings are simple and require drawing a blood sample and taking a few minutes to fill out paperwork.

?Once the paperwork is completed, it?s not even five minutes,? said Nelson.

She encouraged all men in the community to take advantage of the screenings.

?We are trying to reach all men; but of course, African-American men, prostate cancer affects them at a higher rate,? she said.

Bob Jelks, a local prostate cancer advocate and outreach coordinator for the prostate and testicular cancer grant, was on hand at the recent event to provide information and to encourage the men attending.

Bill Anders, 56, a custodian at the Macon County Health Department since April, attended the recent PSA screening after reading about it on a flyer.

?I haven?t had one in a real long time, and I thought that I?m at that age when you need all the early detection you can get,? he said.

Anders said he hasn?t had any friends or family affected by prostate cancer. He said he hasn?t had a regular physical in about two years.

?I worked at a chemical plant for 28 years, and they had blood tests for cancer twice a year,? he said. ? ? It?s a bad disease, but if they can get it early, they can help them. Early detection is a wise choice.?

Binkley said the organizers of the community outreach events and screenings have made an effort to target area men where they live, work and worship to make it easy for them to take advantage of the services.

?Some men are thinking about (their health) more at this time of year because of family and holidays being healthy and wanting to be around, so it?s kind of a nice time,? she said.

When asked why she had done it, Seegrist said, bizarrely, that ?my family makes me nervous.? In other words, there was no reason at all.

As a middle-schooler, I registered the event only in the haziest terms: I knew something terrible had happened, I was glad it hadn?t happened to me, and I figured the adults would take care of the rest. Now, as an adult, what seems shocking is just how little was done. There were calls for keeping guns out of the hands of the mentally ill, for better treatment and commitment laws, for more restrictive gun control, for greater community vigilance to identify people prone to violence. But none of it, apparently, mattered quite enough. Fourteen years after the Springfield Mall shooting came Columbine, then Virginia Tech, and now Sandy Hook Elementary.

Like millions of other heartsick people, I am inclined to despair at this list, to think that though all of this must change, it never will. But as a historian I am reminded that change often comes slowly, and with great pain and effort. A century ago, there were forms of graphic, brutal violence considered so thoroughly American that they could never be banished from the national landscape. Today they no longer exist. In the story of how these changes happened, there may be a model?or a least a bit of hope?for the present.

One example is class violence, once seen a shameful but ineradicable feature of American life. Beginning in the 1870s, the United States became infamous around the world for the brutality of its labor clashes, in which gun battles, dynamitings, and hand-to-hand combat produced what seemed to be an unending stream of senseless death. Sometimes the violence came at the hands of police: 100 strikers killed during the rail uprising of 1877, 11 children burned to death in the 1914 Ludlow Massacre. On other occasions, it came as retaliation from below. In 1910, men employed by the Bridge and Structural Iron Workers blew up the headquarters of the anti-union Los Angeles Times, killing 21 printers and laborers working inside.


Compared to today?s gun massacres, it is easy to see these earlier events as a more comprehensible form of violence, with obvious political motives and straightforward political solutions. Yet Americans at the time experienced them as a cause for national soul-searching, as well as a kind of helplessness and even despair. Muckraker Lincoln Steffens put it best, after the L.A. Americans needed a better process, enforced by the federal government, for managing labor-employer relations. Until the 1930s, advocates simply lacked the political will and public support to make it happen.

An even more intractable debate accompanied the rise and fall of lynching, one of the most gruesome forms of violence ever to take root in the United States. Today, we tend to remember lynching as a clandestine crime, a young black man pulled from his bed in the dark of night and brutalized or hanged in the Southern woods. For most of the late 19th and early 20th centuries, though, it was a community phenomenon of almost unthinkable cruelty, in which hundreds if not thousands of people gathered to witness a victim being disemboweled, castrated, tortured, or burned, then killed in full view.

To modern sensibilities, the injustice once again seems obvious, as do the solutions: Prosecute lynchers, fight for racial justice, strengthen the rule of law, and mobilize public opinion to condemn rather than excuse outbursts of brutality. And yet it took more than 100 years for lynching to begin to disappear as a feature of American life, and even longer for Americans to fully acknowledge the depth of its horror. In the meantime, thousands of influential people, including many esteemed congressmen and senators, argued that lynching was simply a fact of life, a random act of violence about which nothing could be done. It was not until 2005 that the U.S. Senate, spearheaded by Mary Landrieu, apologized for failing to pass federal anti-lynching legislation, and for leaving hundreds of innocent people to be sacrificed to official inaction.

The parallels between past and present are not perfect, of course. Today?s violence is more random, without rational motive or political purpose. Yet these examples tell us something important about how social change happens around violence, and about what we now need to do. Ending both lynching and class violence required efforts spread over many decades. And those efforts attacked the problem at multiple levels, from the passage of new federal laws to campaigns aimed at mobilizing public opinion.

    Friend: Adam Lanza's mom was gun enthusiast

    NEWTOWN, Conn. -- The mother of the suspected Sandy Hook Elementary School gunman, herself slain at the outset of the murderous rampage, was an avid gun enthusiast who liked to take her sons to the shooting range to practice their marksmanship, a friend tells NBC News.

    Dan Holmes, a local landscaper and a friend of Nancy Lanza, mother of 20-year-old suspected gunman Adam Lanza, said she also was a collector.

    ??She had a pretty extensive gun collection,? Holmes said. ?She was a collector, she was pretty proud of that. She always mentioned that she really loved the act of shooting.?


    Holmes recalled that she said she was able to ?focus in? while shooting.

    Federal officials tell NBC News that Adam Lanza took three weapons with him to the school ? two pistols, a Glock and a Sig Sauer, and a Bushmaster .223-caliber semi-automatic assault-style rifle ? all of which were registered to Nancy Lanza.

    It is unclear whether all the guns were used in the attack. At a news briefing on Saturday, Chief Medical Examiner Dr. H. Wayne Carver II, who led the team that autopsied the victims, said, ?All the (injuries) ? I know of were caused by the rifle.?

    The Associated Press reported that authorities investigating the school shooting later recovered additional weapons -- a Henry repeating rifle, an Enfield rifle and a shotgun. It was not clear where those weapons were found.

    Holmes, Nancy Lanza?s friend, said the 47-year-old single mother also frequently talked about how she was worried about Adam.

    Investigators and former classmates of Connecticut school shooter Adam Lanza say he was bright, but extremely shy and remote. NBC's Pete Williams reports.

    Meantime, federal agents visited a gun shooting range near Newtown, Conn., in an effort determine if Adam Lanza visited in the months before the attack, which could indicate he was planning or practicing for the bloodbath he carried out early Friday.

    Dean Price, director of the Wooster Mountain Shooting Range near Newtown, told NBC News that he was visited by agents from the federal Bureau of Alcohol ,Tobacco, Firearms and Explosives on Friday night and that they searched through his records for any evidence that the younger Lanza had signed in there in 2012. They also checked to see if he had used the name of his older brother, Ryan, Price said.

    There was no indication that Adam Lanza had used the shooting range, which requires customers to sign in and show identification prior to using the facility, Price said.

    Agents also have been checking local firearms dealers to see if Adam Lanza purchased or attempted to purchase weapons or ammunition prior to the shooting.

    Law enforcement officials said members of the public reported they thought they saw Adam Lanza trying to buy a rifle at a Dick?s Sporting Good store in Danbury, but investigators have yet to confirm that. ??
